Terms of Service

These terms govern your use of visible.md and the services offered through it. By purchasing an audit or retainer, you agree to these terms.

"We", "us" and "our" mean Marketing Signals Ltd (Company no. 09767832), trading as visible.md. "You" means the individual or organisation purchasing services.

1. The services

visible.md offers three service tiers:

• Rapid Audit ($997, one-off) — automated 48-hour Search Visibility Audit covering 50 prompts across 3 AI engines, 3 named competitors, and a lite SEO benchmark
• Pro Audit ($4,997, one-off) — comprehensive 5-business-day Search Visibility Audit covering 150 prompts across 5 AI engines, 5 named competitors, full SEO authority benchmark, 20-page on-site audit, and a 16-action 90-day roadmap
• Managed ($5,000 month 1 / $9,997 monthly thereafter) — ongoing retainer including the Pro audit and 40-50 hours per month of senior team execution across SEO, Digital PR, content, and technical work

2. Ordering and payment

How orders are placed

Orders are placed by completing payment via Stripe at the price published on the relevant tier page. After payment, you'll be directed to an intake form to provide the information needed to deliver your audit.

Pricing and currency

Prices are quoted in USD and are exclusive of any applicable VAT or sales tax, which will be added at checkout based on your billing location.

Payment terms

Audits (Rapid and Pro) are paid in full at the time of order. Managed retainers are billed monthly in advance, on the same calendar day each month, beginning on the date of the first charge.

Tier credits

Where eligible, "credits" between tiers (Rapid → Pro, Pro → Managed) are applied via a one-time discount code valid for 30 days from the original audit's delivery date. Credits cannot be combined, transferred, refunded as cash, or applied retrospectively.

3. Delivery and timelines

Rapid

Rapid audits are delivered within 48 hours of you submitting your intake form (not from the time of payment). Hours are calculated as elapsed clock hours.

Pro

Pro audits are delivered within 5 business days of intake submission. Business days mean Monday to Friday excluding UK bank holidays.

Managed

Managed engagements begin on the kickoff call. The Pro audit is delivered within month 1. Ongoing execution is delivered against a roadmap agreed during kickoff.

Delays

If we're unable to deliver within the stated timeframe due to circumstances within our control, we'll notify you and provide a revised delivery date. If we miss the revised date by more than 5 business days, you may request a full refund.

Where delivery is delayed by your inputs (e.g., late intake submission, missing access credentials), the timeframe pauses and resumes when those inputs are received.

4. Refunds

Audits (Rapid and Pro)

If, after receiving your audit, you genuinely feel the report didn't deliver value at the price paid, you can request a full refund within 14 calendar days of delivery. We've refunded a small number of audits to date and will continue to do so where the request is made in good faith.

Managed

You can cancel your Managed retainer at any time with 30 days' written notice. Already-billed months are non-refundable, except where we have failed to deliver materially against the agreed roadmap.

How to request a refund

Email gareth@visible.md with your invoice number and the reason for the request. Approved refunds are processed within 7 business days via the original payment method.

5. Your responsibilities

To enable us to deliver, you agree to:

• Provide accurate, complete information at intake
• Provide any access credentials reasonably required (e.g., Google Search Console for technical audit components on Pro and Managed)
• Respond to reasonable requests for information within a reasonable timeframe
• Not misuse the service (e.g., resell our reports as your own work without permission)

6. Intellectual property

Your data

You own all data, text, and content you provide to us. By submitting it, you grant us a non-exclusive licence to use it solely to deliver the service.

The audit reports we deliver

You own the audit report we deliver to you and may use it internally without restriction. You may share extracts publicly with attribution to visible.md / Marketing Signals.

Our methodology and tooling

We retain ownership of the underlying methodology, prompts, scoring frameworks, software, templates, and any improvements we make to them based on aggregate (anonymised) learnings across audits.

Use of anonymised aggregate data

We may use anonymised, aggregated data from across audits to improve our methodology, publish category benchmarks, or write thought-leadership content. We'll never publish data that identifies you, your competitors, or any specifics of your audit without explicit consent.

7. Confidentiality

We treat all customer data, audit findings, and engagement details as confidential. We don't publish customer names, audit results, or strategic recommendations without explicit consent.

If you require an NDA, we'll sign yours or send ours.

8. Warranties and disclaimers

We warrant that the services will be delivered with reasonable skill and care in accordance with industry standards.

We don't guarantee specific outcomes from acting on our recommendations. AI engine behaviours, search algorithms, and competitor activity are outside our control. Any forward-looking projections in our reports (e.g., "modelled lift of X%") are estimates, not commitments.

Except as set out in these terms, all warranties, conditions, and other terms implied by statute or common law are excluded to the fullest extent permitted by law.

9. Limitation of liability

Nothing in these terms limits our liability for:

• death or personal injury caused by our negligence
• fraud or fraudulent misrepresentation
• any other liability that cannot be excluded by law

Subject to that, our total liability to you for any claim arising out of or in connection with these terms or the services — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — is limited to the total fees paid by you to us in the 12 months preceding the claim.

We are not liable for any indirect or consequential loss, loss of profits, loss of business, loss of revenue, loss of anticipated savings, or loss or corruption of data.

10. Termination

Either party may terminate immediately if the other party:

• commits a material breach that isn't remedied within 14 days of written notice
• becomes insolvent or enters administration

Managed retainers may be terminated by either party for convenience with 30 days' written notice.

Termination doesn't affect rights or obligations that have accrued before termination.

11. Force majeure

Neither party is liable for failure to perform due to events outside their reasonable control, including acts of God, war, terrorism, civil unrest, government action, pandemic, fire, flood, internet or hosting provider outages, or third-party API failures. We'll notify you promptly and resume performance as soon as reasonably possible.

12. Changes to these terms

We may update these terms from time to time. Material changes will be notified by email to active customers and posted on this page at least 14 days before taking effect. Continued use of the service after changes take effect constitutes acceptance.

13. Governing law and jurisdiction

These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in this clause restricts your statutory consumer rights, where applicable.
